DW Fox Tucker has a long history of involvement with the South Australian defence sector, with our team members having advised and acted for both government and industry. Our experience as defence lawyers has covered a wide range of commercial legal matters, including acting in contract disputes between industry suppliers and the Department of Defence (Department), strategic advice on alliance structures, compliance reviews of inbound international secondment arrangements, and advising on an application for exemption from anti-discrimination law obligations to comply with US International Traffic In Arms Regulations and the Export Administration Regulations (ITARS).

We have also overseen Department property acquisitions and disposals, reviewed and drafted contractor intellectual property (IP) protocols, guidelines and procedures, including for compliance with third-party IP security obligations, and drafted and reviewed various commercial contracts.

Additionally, we have acted as agents for interstate firms listed on the Defence panel to provide reviews of South Australian laws and terms of contracts.

What Client's Say

We were very impressed by the professionalism, expertise, and team leadership qualities that Brett demonstrated in servicing our ongoing needs during our critical transaction. The transaction was the culmination of 30 plus years of hard work by myself and the Levett Engineering team in growing a South Australian company that supplied complex components to large US defence primes in the Aerospace sector. Brett’s experience ensured that all the legal issues were taken care of while operating in conjunction with the Corporate Finance, Tax and Accounting teams. His ability to engage our team in a respectful and collaborative manner ensured sophisticated legal advice was easily understood so a clear path could be agreed upon to achieve the best possible outcome. Brett and his team worked tirelessly to deal with the complex issues that cropped up during the transaction, and always ensured they were readily accessible to answer any queries. Their responsiveness and efficiency in communications and correspondence was first-class and in conjunction with their professional and practical approach, reassured us that our commercial objectives would always be achieved. It was an absolute pleasure for us to work with Brett and his team throughout this long and quite complex sale process, and we have no hesitation in recommending him and DW Fox Tucker’s M&A team to others aspiring to sell their business.
